Bermuda, the British Virgin Islands, the Cayman Islands, Isle of Man, Jersey and Mauritius are popular offshore jurisdictions for the establishment of trusts for individuals, families and corporations. Our lawyers advise on general issues of trust administration, including creation, variation and termination of trusts; change of domicile; and trustee duties. The team acts as trustee for a number of discretionary trusts and is frequently instructed by blue chip trust institutions.
In Jersey, the firm’s pension practice has a growing reputation amongst leading Jersey corporations and fiduciary service providers advising on the establishment and winding-up of some of the largest pension schemes in the Channel Islands.
For individuals, families and their advisors, we:
- Offer counsel on international estate planning needs
- Help with difficult decisions when administering trusts for
beneficiaries
- Assist in creating a family’s own trust company that, as a result, can
build family unity, empower future generations, and bring efficiency to
administration of family trusts
Additionally, insurance policies are being bought by persons concerned about political risk, forced heirship, or other family financial reasons. US citizens who buy trust-owned policies meeting US tax requirements can achieve considerable tax benefits, especially when the policy is issued by a company with segregated accounts. To help create these opportunities, we:
- Manage master trusts that are created by international life and annuity companies to characterise US dollar-denominated policies sold in non-US markets as investment products rather than insurance
- Create trusts to hold individual policies, thus further anchoring the insurance policies in Bermuda
For businesses, we:
- Offer advice on formation of commercial trusts (special purpose trusts) in connection with leasing and structured finance transactions
Additionally, our affiliated trust companies, can provide trust administration services. In Jersey, the group also provides employee benefit trusts.
